This Circular comes into force from January 29, 2021.
The phrase “hệ thống điều khiển chạy tàu” (“train operation control system”) is removed from Clause 7 Article 3, the phrase “toa xe đường sắt đô thị” (“urban railway cars”) is removed from Point a Clause 2 Article 5 of the Circular No. 29/2018/TT-BGTVT ; The phrase “Biên bản kiểm tra” (“Inspection record”) in the Appendix III and Appendix V of the Circular No. 29/2018/TT-BGTVT is replaced with “Báo cáo kiểm tra” (“Inspection report”).
Clause 3 Article 5 and Clauses 3 and 7 Article 6 of the Circular No. 31/2018/TT-BGTVT are annulled.
The phrase “Cục Đăng kiểm Việt Nam” (“Vietnam Register”) in the following Clauses is replaced with “Cục Đường sắt Việt Nam” (“Vietnam Railway Authority”) Clause 4 Article 13; Clauses 1 and 2 Article 15; Appendix 3; Appendix 4 of the Circular No. 31/2018/TT-BGTVT. The phrase “hệ thống tín hiệu” (“signaling system”) in the following Clauses is replaced with “hệ thống thông tin - tín hiệu” (“information and signaling system”): Clause 1 Article 6 and Clause 4 Article 9 of the Circular No. 31/2018/TT-BGTVT.
Accordingly, the project shall be entitled to import duty exemption according to Clause 11 Article 16 of the Law on import and export duties No. 107/2016/QH13 and Clause 2 Article 6 the Law on railway transport No. 06/2017/QH14 .
However, in order to be eligible for duty exemption, the project’s contractor has to submit the contract-winning notice or contractor appointment; contract of installation, repair or construction or contract of provision of goods, services in which clearly stating import duty- exclusive price.
This Circular shall not apply to periodic or irregular maintenance of national railway infrastructure assets. Read more
This Decision takes effect from April 1st, 2019.
This Circular stipulates assessment and certification of urban railway safety; procedures for examination and verification of safety for urban railway routes being completely constructed or upgraded; periodical certification of safety management system for urban railway routes during operation. This Decree provides for management and protection of railway infrastructure, including: naming of railway lines and railway stations; removal of railway lines; safety perimeter of railway works and railway safety corridor; management and use of land area for rail transport; responsibility for management and protection of railway infrastructure. This Decree takes effect from July 1st, 2018.
“The national railway infrastructure” regulated in this Decree is the railway infrastructure invested and managed by the State, including two types: the infrastructure associated directly with the train operation and the infrastructure not associated directly with the train operation. Read more
The List of national railway infrastructure is regulated in Article 4 of this Decree.
According to Article 3 of this Decree, all national railway infrastructure and its value shall be reckoned up and accounted adequately; those at high risks of facing natural disasters, conflagration and other force majeure events are eligible for finance risk management through insurance or other instruments as prescribed by laws.
The management and use of national railway infrastructure must be done the Prime Minister and the Minister of Transport.
This Decree takes effect from March 14th, 2018.
This Law provides for planning for, investment in, construction, protection, management, maintenance and development of railway infrastructures; railway industry, railway vehicles; railway signals, railway rules and railway safety; railway business; rights and obligations of organizations and individuals involved in railway activities Read more
Under this Law, railway infrastructure business, rail transport business, urban railway business and railway industry are business lines eligible for investment incentives.
An organization or individual involved in railway activities shall be eligible for incentives and support as follows:
- They are allocated land without paying land levy on the land area used for construction of urban and railway infrastructure;
- They are exempt from land rent with regard to land for construction of dedicated railway infrastructure and railway industrial work;
- The railway infrastructure enterprise, urban railway enterprise and railway industry enterprise shall be eligible for incentives for enterprise income tax rate
- They shall enjoy exemption from import duties on machines, equipment, components, railway vehicles, raw materials for manufacture of machines and equipment or spare parts of machines and equipment necessary for construction of railway infrastructures that are yet to be domestically produced;
This Circular is to promulgate the National technical regulations on urban railway operation and maintenance - QCVN 93:2016/BGTVT. Read more
This Circular takes effect from January 15th, 2017.
The national technical regulations on urban railway operation and maintenance deals with basic technical requirements for urban railway operation and maintenance, which ensures that urban railway transport is provided in a safe and continuous manner, thereby creating favorable conditions for passengers and minimizing negative impacts on the community. Read more
This Regulation shall not apply to monorails and tramways.
This Regulation is issued together with Circular No. 42/2016/TT-BGTVT dated December 19th, 2016 which takes effect from January 15th, 2017.
