According to opinions of the General Department of Vietnam Customs, in order to determine management policy and conditions for import of chemicals, it is required to base on analysis and classification results, HS codes of goods items and compare them with these regulations: Read more

- Decree No. 69/2018/ND-CP ;

- Decree No. 13/2017/ND-CP (amended at Decree No. 17/2020/ND-CP );

- Circular No. 32/2017/TT-BCT .

Regarding customs procedure, it is required to carry out according to the guidelines provided at Circular No. 38/2015/TT-BTCstatus2 (amended at Circular No. 39/2018/TT-BTC).

Circular No. 37/2020/TT-BCT dated November 30th, 202 of the Ministry of Industry and Trade on prescribing List of dangerous goods requiring packaging during transport and transport of dangerous goods by road, rail and inland waterway

This Circular provides for new List of dangerous goods requiring packaging during transport, including 1,336 goods items (at Appendix I). Read more

Requirements for packaging materials, conditions and detailed packaging specifications for such dangerous goods are provided in Appendix III enclosed with this Circular.

When transporting dangerous goods whose mass is greater than the levels in Column 7 of the List, escorts are required and the emergency response plan must be made according Appendix IV.

Levels of packaging of dangerous goods (including: high danger; medium danger and low danger) are guided at Appendix II.

This Circular takes effect from January 14th, 2021 and replaces Circular No. 44/2012/TT-BCTstatus1 dated December 28th, 2012.

According to this Official letter “Toluene (C7H8) and Acetic acid (C2H4O2)” are group 2 - industrial precursors of Annex I - List of conditional industrial chemicals in the industry sector of Decree No. 113/2017/ND-CPstatus2 . Read more

Regarding List of industrial precursors, it is promulgated at Annex IV of Decree No. 73/2018/ND-CPstatus2 (60/2020/ND-CP ).

However, it is necessary to note that some products containing chemicals but they are not subject to Decree No. 113/2017/ND-CPstatus2 , such as: pharmaceuticals; cosmetics; animal feed; veterinary drugs; fertilizers; building materials; paints; printing; gasoline; oil., etc (Clause 1 Article 8 of Decree No. 17/2020/ND-CP ).

For chemical preparations used as turbidity agents in the food industry of which ingredients contain esters of fatty acids with glycerol, propylene glycol, limonene, Sodium chloride, phosphoric acid, etc. in liquid form, the General Department of Vietnam Customs assumes that they are suitable to be imposed HS code 3824.99.70 "- - - Other chemical preparations, of a kind used in the manufacture of foodstuff".

According to this Official letter, goods items, machinery, equipment containing "controlled substances", including HCFC và HFC, it is not required to follow procedures for requesting the issuance of the import license for refrigerants.

Official letter No. 2694/TCMT-QLCT dated August 24th, 2020 of Vietnam Environment Administration regarding management of "residual lyes”

According to this Official letter, in case “residual lyes” of HS code 3804 00 90 - "Other" (of heading 38.04 "Residual lyes from the manufacture of wood pulp) have not been treated, tested or controlled their quality as goods, materials for production, they are waste substances and are prohibited from importing into Vietnam. Read more

In contrast, if “residual lyes” have been treated for obtaining sodium lignosulphonate solution, and been tested, controlled their quality, labeled (if any), they are considered to be goods, materials for production, thereby they are allowable to be imported into Vietnam in accordance with regulations on import of chemicals.

Accordingly, local Customs Departments shall only grant customs clearance to shipments of pesticides meeting regulations of customs laws and these requirements:

(i) belong to the List of permissible pesticides in Vietnam (issued together with Circular No. 10/2019/TT-BNNPTNT);

(ii) not included in the List of banned pesticides in Vietnam (issued together with Circular No. 10/2019/TT-BNNPTNT);

(iii) with regard to pesticides regulated at Clause 2 Article 67 of the Law on Plant Protection and Quarantine, they are only imported under the licenses issued by the Ministry of Agriculture and Rural Development.
