“Dispersant” refers to a compound chemical substance employed to break the surface structure of oil trails into small oil trails, break and disperse oil into water columns in form of tiny droplets.

However, only dispersants which satisfy technical requirements specified at Annex I attached to this Circular are permitted for use in response to oil spill incidents

Procedures for using dispersants in response to oil spill incidents are regulated at Chapter of this Circular

This Circular takes effect from February 15th, 2021.

In order to be eligible to apply special preferential import duty rates, in principle it is required to meets these conditions:

+ Goods are included in special preferential import Tariffs promulgated together with this Decrees on special preferential import Tariffs;

+ Goods are imported from countries being members of Agreements;

+ Goods are transported directly from exporting countries being member of Agreements into Vietnam as regulated by the Ministry of Industry and Trade;

+Goods satisfy origin requirements specified in each Agreement, having certificate of origin (C/O) specimen form as regulated by applicable regulations.

This Circular prescribes measurement and quality in gas business and publicizing of gas blending facilities in Vietnam, including liquefied petroleum gas (LPG), liquefied natural gas (LNG) and compressed natural gas (CNG) Read more

Accordingly, LPG importers, exporters, processors and blenders must declare applied standards and adopt measures to perform quality control according to national technical regulations on liquefied petroleum gas before market circulation.

In case of LNG and CNG, importers, manufacturers, processors and blenders must declare applied standards and ensure that gas quality satisfies declared and applied standards before market circulation.

Gas traders shall be responsible for measurement and quality of gas in their distribution systems and jointly responsible for violations regarding gas measurement and quality committed by other traders within their distribution systems.

With regard to gas blenders, this Circular supplements the requirement according to which gas blenders shall prepare self-declarations of gas blending eligibility and submit to Directorate for Standards, Metrology and Quality.

This Circular takes effect from March 15th, 2020.

To replace Circular No. 12/2010/TT-BKHCNstatus1 dated July 30th, 2010, Circular No. 15/2013/TT-BKHCN dated July 12th, 2013 and Circular No. 11/2016/TT-BKHCNstatus1 dated June 28th, 2016.

According to the regulations at Article 5 of this Circular, investor is allowed to transfer foreign currency abroad for doing market research, finding investment opportunities and preparing investment before obtaining the outward investment registration certificate. Read more

However, the investor has to open the pre-investment foreign currency account in order to transfer of foreign currency abroad and has to carry out procedures for applying to the State Bank of Vietnam (SBV) for an approval for the pre-investment transfer of foreign currency abroad.

After the investment project is granted the outward investment registration certificate the pre-investment foreign currency account shall be used as the investment capital account.

Notably, the investor is allowed to open only one pre-investment foreign currency account. If the investment project abroad is invested by two or more investors, each of these investors must open a pre-investment foreign currency account.

In addition, after receiving the outward investment registration certificate, the investor shall carry out the registration of forex transactions the SBV’s branch in province or city.

This Circular takes effect from February 1st, 2019 and replaces Circular No. 36/2013/TT-NHNNstatus1 dated December 31st, 2013.

To abolish Clause 2 Article 28 of Circular No. 12/2016/TT-NHNNstatus2 dated June 29th, 2016.

This Circular provides for the formulation and contents of documents on management of safety for petroleum operations, including: safety management program; risk assessment report, and emergency response plan. Read more

The aforesaid documents shall be formulated:

- Before construction and installation;

- Before testing and commissioning;

- Before alteration or change of capacity, technology, clearance of a work site after the completed production or end of a project, change in safety policies and safety management systems.

Especially, the risk assessment report must be also updated every 5 years.

This Circular takes effect from December 14th, 2018.

This Decree provides for gas business and requirements for gas trading in Vietnam, including liquefied petroleum gas (LPG), liquefied natural gas (LNG), compressed natural gas (CNG). Read more

Accordingly, with regard to gas importers and exporters, this Decree removes the requirements of minimum capacity of gas storage tanker and quantity of LPG bottles with regard to LPG importers and exporters. However, this Decree adds the requirements applied to gas importers and exporters using gas pipelines according to which they must also own gas pipelines and gas distribution stations which satisfy all conditions for safety, fire preventing and fire extinguishing (Article 6).

With regard to gas-producing and gas-processing traders, this Decree also removes the requirements of minimum capacity of CNG storage tanks and minimum capacity of CNG compressor stations. However, this Decree adds the requirements according to which processing line, machines and equipments which are used for gas processing must be tested (Article 7).

Relating to requirements applied to gas sellers and purchasers, this Decree also remove the requirements of minimum capacity of gas storage tanks and requirements of quantity of LPG bottles, LPG bottling stations, distribution channel with regard to bottled LPG traders (Article 8).

However, every LPG bottle circulating on the market must be certified to be conformed to regulations and have its dossier and origin provided by the producer (Article 16).

All gas business facilities (gas producers, processors, importers, exporters, sellers or purchasers; traders producing and repairing LPG bottles or mini-sized LPG bottles; filling stations, distribution stations and compressing stations; traders leasing tanks, bottled LPG warehouse and means of transport) must develop a safe management program and send a report of risk assessment as well as plans for dealing with emergency events to competent authorities for approval (Article 47).

This Decree takes effect from August 1st, 2018 and replaces Decree No. 19/2016/ND-CPstatus1 dated March 22nd, 2016. To abolish Chapter V of Decree No. 77/2016/ND-CPstatus2 dated July 1st, 2016.
